Terms of Service

1. Definitions

In these terms of service:

• LevenDelen: the provider of the online memorial page service
• Customer: the natural person who purchases a memorial page
• Memorial page: the online page in memory of a deceased person
• QR plaque: the physical plaque with QR code that links to the memorial page
• Service: the online memorial service offered by LevenDelen

2. Applicability

These terms of service apply to all offers, orders and agreements with LevenDelen. By using our services, you agree to these terms.

3. Formation of agreement

The agreement is formed when you place the order and have completed the payment. You will receive a confirmation by email.

4. Prices and payment

• All prices include VAT
• Payment is made via iDEAL, credit card or Bancontact
• The price includes the memorial page and QR plaque
• There are no monthly or annual fees

5. Delivery of QR plaque

• The QR plaque will be delivered within 3 weeks of ordering
• Delivery is to the address you specified in the Netherlands
• In case of damage during transport, we will contact you for replacement

6. Memorial page

• The memorial page remains permanently available online
• You can modify the content at any time through your account
• You are responsible for the content you post
• LevenDelen reserves the right to remove inappropriate content

7. Customer responsibilities

You are responsible for:

• Providing correct contact details
• The content you place on the memorial page
• Not posting illegal, offensive or infringing content
• Respecting the rights of third parties (including copyrights on photos)

8. Intellectual property

• The LevenDelen website and software are our property
• You retain the rights to the content you upload
• You grant us a license to host and display your content

9. Liability

• LevenDelen is not liable for indirect damages
• Our liability is limited to the amount of your order
• We are not liable for temporary unavailability of the service
• We are not liable for damage caused by content you post

10. Right of withdrawal

Because the memorial page is created immediately after payment and the QR plaque is custom produced, the right of withdrawal does not apply in accordance with Dutch law.

11. Termination

• You can request removal of your memorial page at any time
• LevenDelen may terminate the service for serious violation of these terms
• If LevenDelen terminates for business reasons, you will have at least 6 months to export your data

12. Force majeure

LevenDelen is not obligated to fulfill any obligation if this is not possible due to force majeure, including internet failures, power outages or other circumstances beyond our control.

13. Changes to terms

LevenDelen reserves the right to change these terms. Changes will be communicated by email and will take effect 30 days after announcement.

14. Applicable law and disputes

• Dutch law applies to these terms
• Disputes will be submitted to the competent court in the Netherlands
• We always try to resolve disputes through mutual consultation first
